1. Agreement to Terms

By accessing or using our mobile applications, including GF Cost Tracker (the "App"), provided by WilfyApps ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the App.

2. Description of Service

WilfyApps provides mobile applications that help users track expenses, manage receipts, and organize financial information. GF Cost Tracker specifically assists users in tracking gluten-free grocery costs for medical expense deduction purposes.

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of the App, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason we deem necessary.

4. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Violate or infringe upon the rights of others
  • Transmit any viruses, malware, or harmful code
  • Interfere with or disrupt the App or servers
  • Attempt to gain unauthorized access to the App or related systems
  • Use automated systems to access the App without permission
  • Impersonate any person or entity
  • Harvest or collect user information without consent

5. User Content

5.1 Your Content

You retain ownership of any content you upload, create, or store in the App ("User Content"). By using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely to provide and improve the App.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights.

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we otherwise find objectionable, without prior notice.

6. Intellectual Property

The App and its original content, features, and functionality are owned by WilfyApps and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

7. Payment and Subscriptions

Some features of the App may require payment or subscription. By purchasing a subscription or making a payment, you agree to:

  • Provide valid payment information
  • Pay all fees associated with your purchase
  • Comply with the terms of any subscription service

All fees are non-refundable unless otherwise required by law. Subscription fees will be charged automatically according to your subscription terms.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the App will be uninterrupted, error-free, or secure. We are not responsible for any losses or damages resulting from your use of the App.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILFYAPPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

10. Indemnification

You agree to indemnify, defend, and hold harmless WilfyApps and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the App or violation of these Terms.

11. Tax and Financial Advice Disclaimer

GF Cost Tracker is designed to help you track expenses for potential medical expense deductions. However, we do not provide tax, legal, or financial advice. You should consult with a qualified tax professional or accountant regarding your specific tax situation and eligibility for deductions.

We make no warranties or representations regarding the accuracy or completeness of any tax-related information or reports generated by the App.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Canada.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
